Property Issues

     
 

What is the benefit of buying a new property?

 

The purchaser can usually specify the finishes to the kitchen and bathrooms in addition, new properties benefit from the latest in styles, specifications (building regulations) and technologies.

   

What if the builders run into major problems and can't finish the property?

 

New Spanish and EU laws have been in place for many years to protect the interests of the purchaser.  The builder must have a bond in place to guarantee the work to completion.

   

Is there a building guarantee with a new property?

 

New properties have a 10-year guarantee very similar to the NHBC warranty in the UK   Although this type of guarantee has been compulsory in many Northern European countries for many years, it only became compulsory in Spain within the last few years.  Most things we buy in this world have a guarantee so it obviously makes sense to have a guarantee on such a large investment as a property.

   

Is the property freehold?

 

Yes

   

How do we know that our money is safe?

 

Your lawyer only releases your money when a bank guarantee is in place specifically for safeguarding your payments. In the case of default you will receive all your money back plus interest.

   

I'm buying a new property, will I be able to inspect it before I complete?

 

Absolutely! With anew property before you instruct your lawyer to complete the purchase, we will inspect the property with you and detail anything that might need putting right.  Once rectified to your satisfaction, the title deeds can be signed.

   
What if I change my mind before completion?
 

You are committed to the Private Purchase Contract but some people do sell their new property before completion and can benefit from profits of up to 30% or more on the money they initially invested!

   

Could I pay less for my new home by going elsewhere?

  Whether you go directly to the vendor or even another agent the price will be the same and they will not offer you the peace of mind our first class support and after sales service provides.
   

I may want to rent this property out. Can you help with this?

  Of course, and as part of our service we can help you with all aspects of property management.  Even allowing for mortgage payments and letting costs, you can enjoy a healthy rental income from your new property.
   

Who pays the commissions on property sales?

 

The current property owner. We never take commission or fees from you the buyer.

 


Regarding The Legal Process

   

Should I use a solicitor from my own country?

 

The choice is yours, however the majority of buyers prefer to deal with a local solicitors firm as they are well versed with local laws and process.  All communications from your Spanish lawyer will be in your own language.

   
Do I have to be in Spain for each stage of the legal process?
 

No. You can instruct our lawyer to act on your behalf, even for the final completion.

   

Can I get a mortgage?

 

Yes. They are readily available both in the UK> and Spain. 4 Sale Network will be only too pleased to help as we have access to independent mortgage brokers.

   

In whose name should you purchase the property?

 

There are a number of ways to purchase the property:-

In your name
In the joint names of you and your partner
In your children's names
In the name of a limited company

Each method has it's own advantages and disadvantages and everything depends on your own personal circumstances. Your legal representative will be pleased to discuss the various ways of buying and to advise you on the most advantageous method taking into account your personal situation, capital gains and inheritance tax.

   

Is there a land registry system in Spain?

 

Yes. After the escritura (title deed) has been signed in front of the Notary, it will be taken to the land registry for registration and payment of fees. When the deeds are ready, your lawyer will have them checked and forwarded to you.

   
What happens if I want to live in Spain?
 

You are required by law to obtain an NIE number which is your tax identification number as a foreign resident and a residency card (Tarjeta Comunitaria). Your lawyer can assist you with "residencias", work permits (if required) and licences. They will also advise you on the importation of cars, furniture and electrical goods, payment of pensions in Spain, National Insurance and other related matters.

   

What happens about utilities like water and electricity?

 

You will need to have the utilities transferred to your name, register for local rates and notify the Town Hall that you own the property.  You may have to register as the new owner with the Community Owners if you live in an apartment or urbanisation with shared facilities.

   

What are community fees?

 

Community fees apply for properties that have the benefit of communal areas or services such as a swimming pool, security, gardens and general maintenance.  Your Estate Agent will ensure you have all this information before you make the final decision.

   

How much should I allow for costs?

 

Normally you should allow an additional 10% on top of the purchase price which can be broken down approximately as follows:-

Transfer Tax (Stamp Duty) 6.0% (pertaining to resale property)
Legal Fees (approx) 1.0%
Land Registry Fees 0.75%
Notary Fees 1.0%

If the property is new you will pay I.V.A. (VAT) of 7% instead of the 6% Stamp duty plus a 0.5% Document Tax. Your lawyer will give you a detailed breakdown of the costs as part of their quotation. if you're considering a mortgage, an arrangement fee is payable along with the costs of the survey.

 


General Questions

   

What's the weather like in Winter?

 

Much, much warmer than Northern Europe with a lot less rainfall. Most people on the Costa's don't even feel the need for central heating and with over 320 days of sunshine every year, overcoats are a rare sight even in December and January.

   

Should we learn the language?

 

If you're planning to live and work in the Spanish community it is advisable. Spanish is regarded as one of the easier languages to learn and many people get started using a phrase book or basic cassette tape. For the more serious there are dozens of low cost language schools that cater for students of all ages and ability!

   

I've never driven in Spain, what are the roads like?

 

Much less congested than most of Northern Europe and, because of the weather, driving on wet roads becomes a rarity rather then the norm.  It normally only takes a few days of being careful to get used to driving on the right and most of the road signs are the same. Spain's a big country with lots of open spaces, fantastic motorways and lower traffic densities particularly away from the main costal roads during August. Many of the more populated areas are served by Autovias (some are toll roads) which are accessed for only a few Euros and are far less busy than our motorways.

   
How do the Spanish treat the English who live there?
 

The Spanish people are tolerant, very family oriented and friendly, even more so if you learn few simple Spanish phrases. The recent economic prosperity means that the Spanish are enjoying life to the full, particularly in the costal areas, where new foreign arrivals are general seen to be contributing to the fiscal growth of the region. Living amongst the Spanish has proved to be very popular for millions of us and few go back to the UK.

   

What's the situation regarding hospitals and health care in Spain?

 

All the Towns and most development areas have their own healthcare centre covering practitioners, specialists and emergencies. To be seen by a Doctor, you will need to bring your Form E-111 that is available from your Social Security Office or Post Office here in the UK.

Private Health - there are private clinics within the majority of the areas we cover. To receive treatment you can either pa per consultation or pay into a private health scheme.

Torrevieja is proud of it's private hospital the San Jaime. it is renown throughout Europe for it's facilities and as being one of the top cancer hospitals. Completed in 2002 it is a large hospital with English-speaking doctors and staff. Patients travel from around the globe to seek the expertise found here.

   

What's the worst thing about living in Spain?

 

Siesta! Many shops and offices close for 2-3 hours in the afternoon. Also, you may find that long lost relatives and friends suddenly appear out of the blue and stay!

   

Taking your pets abroad?

 

You will require a pet passport. To obtain this your pet must have a rabies vaccination and blood tests which can be carried out by your vet who will also provide an identity chip. You will receive a health certificate around six months later.

   

What's the position regarding residency?

 

If you stay in Spain more than half the year (182 days) then you will need to obtain a residence card. If you plan to work or start a business, you are required to apply for a permit within 15 days of your arrival in Spain. The period of issue for a residence card is usually five years. If you reside in Spain for more then 182 days in a calendar year then you may be liable to pay Spanish income tax on your worldwide income.

   

What's a fiscal identification number?

 

All residents and non-resident foreigners who have financial affairs in Spain such as property ownership must have a "foreigners identification number". This is obtained very easily and guidance will be given when Spanish bank accounts are opened.
